This property is being offered for sale by the Toowoomba Regional Council pursuant to its statutory power of sale contained in the Local Government Regulations 2012. The property is the subject of financial arrears by the registered owner to the Toowoomba Regional Council for overdue payment of Council Rates & Charges.

The property is submitted for sale on the basis that the highest offer to purchase received shall be the purchaser subject to the vendor's approval. The property sale is subject to terms and conditions necessary for the Toowoomba Regional Council to comply with its responsibilities under the Local Government Regulations 2012.

Offers will only be considered from Offerors who have formally acknowledged they understand and accept the terms of sale.

The Council offers NO guarantee, warranty or other assurance:
* that vacant possession of the property will be provided at completion;
* as to the condition, state of repair or suitability for any use of the land;
* that the land presently is being used in accordance with approvals (if any) granted by the Commonwealth, State or local governments, or by any semi-government authority; and
* that any improvements (if any) on land have been constructed in accordance with all applicable legislative requirements of the State or local governments

Any chattels located on the land are NOT included in the sale and will become the responsibility of the purchaser. If, at any time between the formation date and the completion date of the Contract of Sale, the Council becomes aware that payment of the overdue rates burdening the land was tendered prior to the closing date of this Expression of Interest to purchase, then the Council may terminate the agreement by written notice to the purchaser in which event all monies paid by way of deposit are refundable.

The Council give notice that intending purchasers should satisfy themselves by way of their own inspection, searches, inquiries, advices or as is otherwise necessary in relation to this property. The Council's Agent is not authorised to conduct any public Open Homes or private inspections of the property. The Council or its Agent are unable to provide a price guidance to buyers during this EOI process.
